TOYA SA (The “Issuer”) announces that on 26 September 2016 TOYA S.A. received information from MaxCom SA based in Tychy of the withdrawal by MaxCom SA of the Termsheet of 20 May 2016 (hereinafter the “Termsheet”), on conclusion of which the Issuer informed in the current report No. 12/2016 of 20 May 2016. The reason for the withdrawal is the lack of acceptance by the Issuer of the change proposed by MaxCom SA regarding the growth of investment valuation above the assumptions indicated in the Termsheet.
